By accessing or using the services provided by Optera Finance ("we," "us," or "the Company"), you agree to be bound by these Terms and Conditions ("Agreement") and all applicable laws and regulations. This Agreement constitutes a legally binding contract between you and the Company.
We reserve the right to amend these Terms at any time. Continued use of the platform following any such amendments constitutes your acceptance of the revised Terms. We recommend reviewing this page periodically.
Platform Description
Optera Finance is an online investment management platform that provides users with access to managed portfolios across multiple asset classes, including but not limited to real estate, foreign exchange (Forex), cryptocurrency, oil & gas commodities, and retirement planning strategies.
Our platform allows registered users to:
- Create and manage investment accounts
- Select from curated investment plans with defined return schedules
- Deposit and withdraw funds through supported payment channels
- Monitor portfolio performance through a real-time dashboard
- Participate in our affiliate referral programme
- Access transaction history, account statements, and support services
Eligibility
To use our services, you must satisfy all of the following eligibility criteria:
- You must be at least 18 years of age at the time of registration.
- You must have the full legal capacity to enter into a binding agreement under the laws of your jurisdiction.
- You must not be a citizen or resident of any jurisdiction where the use of our services is prohibited by law.
- You must not be on any government or international sanctions list.
By registering, you represent and warrant that you meet all of the above criteria. The Company reserves the right to request documentation to verify your eligibility at any time.
Account Registration & Security
To access the platform, you must create an account by providing accurate, complete, and current information. You agree to promptly update any changes to your personal information.
You are solely responsible for:
- Maintaining the strict confidentiality of your login credentials, including your password and two-factor authentication codes.
- All activity that occurs under your account, whether or not authorised.
- Notifying the Company immediately at support@opterafinance.com if you suspect any unauthorised access to your account.
The Company will not be liable for any loss or damage arising from your failure to comply with these security obligations. You may not share your account credentials with any third party or operate multiple accounts without prior written consent from the Company.
Investment Plans & Returns
Optera Finance offers a range of investment plans with defined investment periods and projected returns. These plans are subject to the following conditions:
- Minimum Investment: Each plan has a specified minimum deposit amount. Investments below this threshold will not be accepted.
- Projected Returns: Return rates displayed on the platform are projections based on historical performance and current market conditions. They are not guaranteed and may vary.
- Lock-up Periods: Certain plans may have defined investment periods during which funds cannot be withdrawn. Early termination may incur penalties.
- Compounding: Where applicable, returns may be compounded over the investment period as specified in the plan details.
- Plan Changes: The Company reserves the right to modify, suspend, or discontinue any investment plan with reasonable notice to affected investors.
Deposits & Withdrawals
Deposits may be made via the payment methods listed on the platform, which may include cryptocurrency transfers and other electronic payment methods. All deposits are subject to a verification process and are non-refundable once an investment plan has been activated.
Withdrawal requests are subject to:
- Minimum withdrawal thresholds as specified in your account settings.
- Identity verification and KYC/AML screening procedures.
- Processing times of 1–5 business days, depending on the payment method and jurisdiction.
- Applicable network or processing fees, which will be disclosed at the time of the withdrawal request.
The Company reserves the right to delay or withhold withdrawals pending completion of compliance checks or in the event of suspected fraudulent activity.
Investment Risks
Specific risk factors associated with our investment asset classes include:
- Market Risk: The value of investments may fluctuate due to macroeconomic factors, market sentiment, and geopolitical events.
- Liquidity Risk: Certain investment products may not be readily liquidated, particularly during periods of market stress.
- Currency Risk: Investments denominated in foreign currencies may be adversely affected by exchange rate movements.
- Cryptocurrency Volatility: Digital assets are highly volatile and may experience significant price swings in short periods.
- Regulatory Risk: Changes in law or regulation may adversely affect the value of certain investments or our ability to provide services in certain jurisdictions.
Affiliate Programme
The Optera Finance affiliate programme allows registered users to earn referral commissions by inviting new investors to the platform. Participation in the affiliate programme is subject to the following terms:
- Affiliate commissions are earned as a percentage of deposits made by referred users within the applicable referral window.
- Commission rates are displayed on the Affiliate page and are subject to change.
- Affiliates must not engage in spam, misleading advertising, or any other deceptive promotional practices.
- Self-referrals — creating a secondary account to earn a commission on your own deposit — are strictly prohibited and will result in account termination and forfeiture of earnings.
- The Company reserves the right to withhold commission payments pending investigation of suspected abuse.
Prohibited Activities
You agree not to engage in any of the following prohibited activities:
- Using the platform for money laundering, terrorist financing, or any other unlawful financial activity.
- Attempting to gain unauthorised access to any part of the platform or its underlying systems.
- Introducing or transmitting any malware, virus, or other harmful code.
- Reverse-engineering, decompiling, or disassembling any portion of the platform.
- Using automated bots, scrapers, or similar tools to access the platform without our express written permission.
- Providing false, inaccurate, or misleading information during registration or at any other time.
Violation of any of these prohibitions may result in immediate account suspension or termination, forfeiture of funds, and referral to the appropriate legal authorities.
Intellectual Property
All content and materials on the Optera Finance platform — including but not limited to the platform's design, code, graphics, logos, trademarks, text, and data — are the exclusive property of the Company or its licensors and are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to access and use the platform solely for your personal investment activities. You may not reproduce, redistribute, modify, or create derivative works from any platform content without our prior written consent.
Limitation of Liability
To the maximum extent permitted by applicable law, the Company and its directors, officers, employees, and affiliates shall not be liable for:
- Any investment losses, including loss of principal, arising from the use of our services.
- Any indirect, incidental, consequential, or punitive damages of any kind.
- Any loss arising from platform downtime, technical failures, or force majeure events beyond our reasonable control.
- Third-party actions, including fraud or misuse by other platform users.
In all cases where liability cannot be excluded, our aggregate liability to you shall not exceed the total amount of funds you have deposited with the Company in the twelve (12) months preceding the relevant claim.
Privacy & Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the platform, you consent to the data practices described in our Privacy Policy.
We comply with applicable data protection legislation and maintain appropriate technical and organisational measures to protect your personal data from unauthorised access, disclosure, or destruction.
Indemnification
You agree to indemnify, defend, and hold harmless Optera Finance and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the platform.
Termination
The Company may suspend or terminate your account at any time, with or without cause, including for failure to comply with these Terms. Upon termination, your right to access the platform ceases immediately. Any outstanding balances will be handled in accordance with applicable law and our internal procedures.
You may close your account at any time by contacting our support team. Pending investments that have already been activated will continue to be governed by the applicable plan terms until maturity.
Dispute Resolution & Governing Law
These Terms shall be governed by and construed in accordance with applicable laws. In the event of any dispute arising from or in connection with these Terms, you agree to first attempt to resolve the matter by contacting our support team.
If an amicable resolution cannot be reached, any dispute shall be submitted to binding arbitration in accordance with internationally recognised arbitration rules. The arbitral award shall be final and binding on both parties.
